Protection of Personal Data and Health Data

Fysiolab BV attaches great importance to the protection of your personal data and we process your personal data with due care and attention to the security of this data. Personal data is all data that allows you to be identified as a person. Fysiolab BV complies with the legal provisions regarding the protection of personal data and the rights you have as a patient (including AVG and the law on patients’ rights). In this statement, Fysiolab BV explains how it collects, processes and uses your personal data. It thus forms the general policy of Fysiolab BV in the field of data processing.

Fysiolab BV collects and processes data about you when you are treated and cared for by us as a patient or when you contact us in any other way.

If you are a supplier, your data or those of your contact persons will be processed in the context of these activities, as well as when processing invoices and other accounting documents.

Finally, we may process data about you because it is or may be important for our activities, for example to be able to rely on your advice or services.

Purpose of processing

The personal data is processed by us with the aim of providing good healthcare. We comply with the legal obligations imposed on us as a healthcare provider and are subject to professional secrecy (or duty of confidentiality).

It concerns the data that you provide to us and that we need for your treatment and care as a patient for which you rely on us, such as your name and address, e-mail address and all other data in that context, in particular the data related to your health. You usually provide us with this information directly, but it is also possible that we obtain this information from other parties, such as your general practitioner or other specialists.

The data may also relate to your leisure activities or consumption habits, in particular where these may be related to your care. Financial data must be processed in the context of accounting processing. Data about your position and activities are processed in the context of communication or public relations.

We collect this information both when you complete our paper forms and when you do so electronically.

A number of personal data can also be used for the financial settlement of your treatment, no further immediately identifiable data is used for accounting processing.

According to the legal provisions, your physiotherapy file must be kept for 20 years after the last treatment and/or the file has been closed. Other information that is not part of your medical file is kept for the periods laid down by law or no longer than necessary to fulfill the purpose of the processing.

Basics for processing data

In principle, we collect and process your data on the basis of the contractual relationship we have with you as a result of your request for care and treatment and the physiotherapeutic contract that we conclude with you for this purpose. In other cases, the processing is based on the public interest tasks that we perform as healthcare providers.

The contractual relationship is also the basis for the processing of supplier data.

Where the processing is not necessary to perform the contractual relationship, such as communication, it is based on our legitimate interests as a healthcare provider, in particular freedom of association and information. We always ensure that there is a balance between our and your interests.

Data Sharing

The data we process from you will only be shared in the context of your healthcare with doctors or healthcare providers with whom you have a treatment relationship or otherwise shared anonymously. Only this information is shared that is necessary for your treatment by another healthcare provider.

If you have given your informed consent, this data will be made digitally available to other healthcare providers in a secure manner. Only if you enter into a treatment relationship with these healthcare providers will they actually have access to your data.

In the context of legal obligations such as reimbursements of assistance provided by insurance institutions, certain data is also shared with your own health insurance fund, or for uninsured patients at the expense of the OCMW, with your own OCMW.

Data may also be processed for cooperation in scientific research. All processing is done by bodies that have received the correct permissions and authorizations for the processing of this data. Data is aggregated and all measures are taken so that it cannot be traced back to individual persons.

Your rights as a patient

You have the right to inspect your own personal data. You can request, view, correct and possibly change these. In certain cases you can also ask to temporarily limit the processing of the data. These questions can only be refused if they pose a serious threat to your health. A request to delete personal data or limit its processing is only possible if there are no legal obligations regarding the processing and retention periods of this data. Questions to inspect your file can be directed to your general practitioner. If you have any questions or complaints, you can always contact your doctor or healthcare provider.

If you suspect an infringement of the processing of your personal data and your doctor or healthcare provider cannot provide a definite answer, you have the option of submitting a complaint to the Data Protection Authority(GBA).
